This agreement represents the
complete agreement and understanding between
Access Orlando (hereinafter called AO) and the
account holder and supersedes any other oral
agreement. AO may modify these terms and
conditions, amplify them, and/or modify the
prices, as well as discontinue or change the
services offered. If you do not agree to these
terms and conditions, please notify our
accounting department so we may initiate a
closure of your account.
- 1.0 Provision of
Services
- 1.1 AO will provide services on
its computing and network systems to
individual account holders in exchange
for payment of fees and compliance with
the terms and conditions of this
document.
- 1.2 AO services are defined as the
provision to the account holder of
computing, telecommunications, network
software, and information services
provided by AO. These services also
include, but are not limited to, the
provision of access to computing,
telecommunications, software, and
information services provided by others.
- 1.3 AO services include access to
all publicly available resources on the
internet. Some of the information
available may contain content (e.g.,
language or images) about subjects
intended for Adult audiences. Some
information available over the Internet
may even be illegal to transmit or
posses. Account holders less than 18
years old must have a parent or legal
guardian agree to these conditions to
indicate acceptance and knowledge of
this.
- 1.4 AO will provide data storage
to the account holder, but not data
backup. Account holder is responsible for
data backup at regular intervals to
prevent data loss.
- 1.5 AO will publish a notice of
fee increases 30 days before such
increases take effect.
- 1.6 AO will provide access telephone numbers
for the purpose of connection to the Internet. AO will make
every effort, based on the information provided by the account holder,
to provide a local telephone number for connection to the Internet.
However, since
AO cannot determine the account holders location when calling,
AO will not be responsible for any expanded area, long distance
or extra phone line charges or penalties, taxes or interest incurred
while connecting to or using an AO
access telephone number. The account holder is solely responsible for
contacting the telephone company providing their service
to verify the telephone numbers they are dialing are local,
expanded area or long distance
and any possible charges that may be incurred when calling an
AO access telephone number.

- 2.1 Public Domain materials (e.g.
images, text, and programs) may be
downloaded or uploaded using AO services.
Account holders may also re-distribute
materials in the public domain. The
account holder assumes all risks
regarding the determination of whether
the material is in the public domain.
- 2.2 As provided by United States
federal law and by International
treaties, copyrighted materials (e.g.
images, text, and programs) may not be
uploaded using AO services without the
permission of the copyright holder.
Copyrighted materials may be downloaded
for personal use. Except as expressly
permitted, materials under copyright may
not be distributed to others. Copyrighted
material may not be changed nor can the
author attribution notices nor the
copyright notices be modified.
- 2.3 Note that some materials
available are called SHAREWARE.
These materials may be downloaded and
used, but they are copyrighted materials.
The copyright holder usually gives
permission to use the materials for
examination. If you choose to continue
using the materials, the copyright holder
requests that you register your usage and
may ask that you pay a license fee.
- 2.4 Copying, uploading,
downloading, or distribution through AO
resources of commercially licensed
software may be a violation of the
software's license, and if so, is
forbidden. AO will cooperate fully with
law enforcement agencies in prosecuting
software piracy offenders.

- 3.1 AO network accounts are for
the account holder and the account holder
therefore agrees to neither share the
account, nor use the account to share AO
sensitive information with others. The
account holder acknowledges that AO will
terminate the account without notice if
the account holder does not comply. The
account holder is defined to be the
person, persons, or entity who
established the contract for services.
- 3.2 Only one simultaneous dial-in
per account holder. This means that you
cannot use 2 of our dial-in ports at the
same time. If you are found logged in
more than once, we will assume that your
password has been compromised and will
suspend your account without notice.
There are some circumstances when we may
permit multiple dial-ins, please contact
us if you have good reason to do this.
Note that while dial-in connections are
limited to one, you may have as many
telnet and like serviced sessions as you
like. Dial-in account holder idled for
more than twenty (20) minutes will be
reset.
- 3.3 The account holder agrees to
maintain a secure password to the
account. Secure passwords are those that
are between 6 and 8 characters long, and
contain a mix of upper and lower case
letters, numbers or other characters, and
can not be found in direct or reverse
order in any dictionary, regardless of
the language of the dictionary.
It is extremely important
that you pick a good password and that
you guard it carefully. Your password
should be hard to guess, and should
include a good mixture of upper and
lowercase characters and special
characters. Don't include anything in
your password that could be guessed by
somebody who knows you. Your password
should *not* be based on your name, or
the name of anyone you know, or on your
birth date or social security number,
phone number or information that could be
guessed or discovered by somebody. Avoid
common English and foreign words, proper
names, and any word that is likely to be
in a dictionary.
If your password is a random string of
mixed characters as above, it is
reasonably safe. If not, it can be
discovered by an intruder by a dictionary
search such as the one performed by the
program 'crack'. If this happens, your
account may be broken into and you may
lose files. If such loss occurs, we may
be able to restore your files from backup
tapes. In some cases intruders have been
known to create large amounts of files
into compromised accounts. if this
happens to your account, you may incur
additional disk charges.
Good passwords look similar to these.
(But don't use these specific passwords
or any derived from them.)

The following are
terrible passwords. They look good
because they seem random, but they are
bad because they are derived from key
sequences on the standard keyboard:

Once you have picked a
good password, take steps to make sure
nobody else finds it out. When you are
typing your password in the presence of
others, it is a good idea to to block the
view of the keyboard with your body. Some
people will have no problem reading your
password by watching your fingers move.
DO NOT TELL ANYBODY
YOUR PASSWORD!
At no time should you
reveal your password to anybody, even if
somebody claims to represent Access
Orlando and asks for your password.
- 3.4 The account holder agrees not
to use any process, program, or tool via
AO services for guessing or obtaining the
passwords of account holders on AO or
other systems. The account holder agrees
not to use AO services to make
unauthorized attempts to access AO
systems or the systems and networks of
others, or to deny authorized users
access to any systems. The following
lists some of the unauthorized uses of
AO's system:
Trying to obtain
root login or another customer's
login on our machines.
The use of packet
sniffers or other malicious
hacking programs.
Making public,
providing, or posting any of our
system files to other users of
the Internet.
Storing, posting,
or making public through AO's
network pirated software (warez)
or other illegal copies of
copyrighted material.
Snooping,
disturbing, or otherwise
harassing other users, AO staff,
AO customers, their files, or
their directories.
Running software
designed to cause our system to
stop working correctly.
Attempting a
Denial of Service (DoS) attack or
other illegal activity from or
through AO's system.
- 3.5 One background process is
allowed for each user and must be
registered with AO. More than one will
result in ALL processes getting killed.
The background process registration file
must exist in the account's home
directory and be called aoproc.reg.
Background processes must comply will all
of the terms and conditions stated in the
background process registration form. AO
reserves the right at any time to
terminate any user process.
- 3.6 Disk quotas are specified
based upon the account type and services
purchased. Going over the account disk
quota may result in suspension of the
account and/or additional usage charges.
Addition disk space may be purchased to
raise your quota.
- 3.7 Your available bandwith is
specified based up the account type and
services purchased. You may make whatever
material you like available for FTP or
WWW as long as it is legal and it does
not generate traffic in excess of your
account bandwidth quota. For this reason,
we strongly recommend that our customers
avoid storing any adult-oriented
materials here. If your Internet site
suddenly consumes huge amounts of
bandwidth, we have the right to restrict
access to it and/or to charge you for the
additional bandwith usage. Please contact
us in advance if you think this may
happen and we can make suitable
arrangements.
- 3.8 The account holder agrees not
to use any process, program, or tool via
AO services for the purpose of annoying
other users at AO systems or any other
systems on other portions of the
Internet. This includes, but is not
limited to, flash-bombing, mail-bombing,
and subscribing other people to mailing
lists.
- 3.9 The account holder agrees to
use the services provided by AO as
permitted by applicable local, state, and
federal laws. The account holder agrees,
therefore, not to use these services to
conduct any business or activity or
solicit the performance of any activity
that is prohibited by law.
- 3.10 The account holder
acknowledges that AO is a commercial
entity and may be used by account holders
to conduct legal businesses if the user
has registered with AO as a business or
corporate entity. These businesses
should, however, not impinge upon the use
of AO services by other account holders.
AO services should not be used to send
unsolicited advertising or promotional
materials to other network users.
Electronic mail and appropriate USENET
newsgroups may be used in the conduct of
legitimate businesses.
- 3.11 The account holder agrees to
not, under any circumstances, post
messages to newsgroups, mailing lists, or
similar public forums if any of said
forums pertain to subjects not directly
related to the main topic of the posting
or if the posting would be considered
inappropriate for any other reason. This
applies to both business and non-business
oriented postings. Such postings will be
considered abuse of AO systems services.
- 3.12 User accounts established as
personal accounts may only use the
systems facilities for personal or
non-business enterprises. Failure to
register as a commercial entity, may
result in surcharges, interruption of
service and/or termination of accounts.
Users found to be operating commercial
enterprises in violation of this
agreement understand that they will be
charged in accordance with our corporate
fee schedule.
- 3.13 All AO services, both
personal and commercial are not intended
for resale. Resale of AO services without
making specific arrangements with AO is
not permitted and may result in
surcharges, interruption of service
and/or termination of accounts.
- 3.14 AO reserves the right to take
actions it deems appropriate against
users that violate the spirit and intent
of its terms and conditions.

- 4.1 The account holder
acknowledges that AO makes an honest
effort to keep the information available
on AO's systems accurate. However, AO can
make no warranty of any kind, either
expressed or implied, regarding the
quality, accuracy, or validity for the
data and/or information available. Use of
information obtained from or through AO
is at the risk of the account holder.
AO system is not
configured for high security. Standard
Unix type operating systems are used
without the optional high security
features enabled. Certain types of
network activities such as rlogin
and finger
are enabled at
many security-conscious sites. This is to
make the systems easier to use but the
tradeoff is that the network is slightly
easier to compromise. Because of this, it
is not recommended that the AO systems be
used for activities that require a high
degree of system security.
The current systems in
use at AO (and throughout the Internet)
were not designed to prevent forged
electronic mail from being sent. If you
are the recipient of email with critical
information or something difficult to
believe, it is in your best interest to
verify the message with a alternate
means.
- 4.2 The account holder also
acknowledges that the information
available through the interconnecting
networks may not be accurate. AO has no
ability or authority over the material.
AO can make no warranty of any kind,
either expressed or implied, regarding
the quality, accuracy, or validity of the
data and/or information residing on or
passing through these networks. Use of
information obtained from or through AO
services is at the risk of the account
holder.
- 4.3 AO system is not configured
for backup of account holder data. Any
critical data should be backed up by the
account owner at regular intervals to
prevent data loss. Customer critical data
master copies should not be keep on the
system. As a rule of thumb, customer data
such as credit card numbers, ordering
information, or customer passwords should
be backed up or removed from the system
as quickly as possible to prevent data
loss.
- 4.4 The account holder agrees to
indemnify and hold AO harmless from any
claims, including attorney's fees,
resulting from the account holder
receiving AO services which cause direct
or indirect damage to another party.

- 5.1 The AO accounting cycle begins
on the 1st, 7th, 15th or 23rd of each
month. The billing cycle is determined
from the activation date of your account.
For example, if your activation date is
on the 8th, the billing cycle begins on
the 15th of the month. Accounts will be
billed by month or annually, based on the
account's activation date and the payment
option selected.
- 5.2 New accounts wishing to
discontinue service within the first
thirty (30) days may do so, and will be
charged only for the first month of
service plus activation where applicable.
Any accounts established longer than one
month are responsible for fees as normal
and will not be refunded. Automatic
withdrawal accounts that are not used
will continue to be billed, unless
written notice of cancelation is
received.
- 5.3 Service payments will be
submitted in advance of receiving
services.
- 5.4 Delinquent accounts are those
that remain unpaid at the beginning of
the next accounting cycle.
- 5.5 Accounts that are delinquent
are put on accounting suspension
and may not be used, any hardware located
at AO's offices will be disconnected.
Accounts that are unpaid for thirty (30)
days automatically have their files
archived. Accounts that are unpaid for
more than forty-five (45) days are closed
and will require re-payment of activation
fees where applicable. AO accounts
continue to accrue charges while they are
on suspension.
- 5.6 The account holder
acknowledges responsibility for the
account until payment in full is made.
- 5.7 A $20.00 returned check fee
will be assessed for any check returned
for any reason. Accounts paid by a
returned check may be suspended until
their balance is paid in full, including
returned check fees.
- 5.8 Fees specified in any written
contracts between Access Orlando and
account holder will overrule any similar
fees mentioned in this policy.

- 6.0 Account
Cancellations
- 6.1 Cancelation requests for AO
accounts must be received in writing via
email, fax or postal service at AO's
office. Cancelation by telephone will not
be accepted. Cancelation requests must be
received before the end of the accounting
cycle period. The account is not be
cancelled until AO receives the notice.
Send cancelation emails to: billing@ao.net
include your full name, your username and
the date you want the account cancelled.
- 6.2 All AO accounts must be paid
in full before the transaction will be
considered complete.
- 6.3 Non-use of service does not
constitute cancelation of account.
- 6.4 There is no refund
for partial monthly useage.
- 6.5 Any colocated
services customer wishing to remove their
equipment from our offices must give 24
hours notice before doing so.

- 7.1 Any use of AO system resources
that disrupts the normal use of the
system for other AO customers, or the use
of other systems by their respective
users is considered to be abuse of system
resources and is grounds for
administrative intervention.
- 7.2 Modification, alteration,
reverse engineering, decompilation,
disassembly or creation of derived works
based on AO proprietary network protocols
or software is an abuse of AO services.
- 7.3 Depending on the nature and
the severity of the abuse, the user may
receive an E-mail warning or have their
account suspended by AO Staff without
notice. If the misuse is unintentional,
the suspension may be rescinded following
discussion with AO Staff. If the misuse
is intentional, the suspension may be
rescinded at the discretion of the
Operations Manager. Occasionally,
unintentional misuse is misclassified as
intentional misuse. Customers who believe
their activity has been misclassified may
appeal to the Operations Manager.
- 7.4 Violations of any of the AO
conditions of use are unethical and may
be criminal offenses. You are expected to
report to AO any information you may have
concerning instances in which the
conditions of use have been or are being
violated. When AO becomes aware of
possible violations, we will initiate an
investigation. At the same time, in order
to prevent further possible unauthorized
activity, AO may suspend access to
services to the individual account in
question. Confirmation of violations may
result in cancellation of the individual
account and/or criminal prosecution. The
account suspension may be rescinded at
the discretion of the Operations Manager.
- 7.5 Unsolicited Commercial Email
(UCE, UBE or Spam) is in violation of AO
Policy. The sending of such will result
in immediate suspension of the account
and a charge of at least $500 for the
cleanup and resources consumed by the
abuse reports. This is neither negotiable
nor waivable, and this IS your
warning. AO determines if email is
unsolicited by complaints to abuse@ao.net
or notification by independent Spam
notification services. By agreeing to
these terms of service you accept that we
will fine you for the above amount if you
are found to be in violation of this
section. Don't be like this
guy
- 7.6 Advertising via
"Proxy". If someone advertises
for your website/services by using UCE,
your website/account will be shut down
without warning. Make sure the person(s)
you contract to advertise for you
understand that it is not acceptable. As
a bit of advice, NOBODY has a "huge
list of people who asked to hear about
new products.". Anyone claiming that
is not a legitimate buisness. Your
advertising money is better spent on a
reputable agency and on webdesign for
your site.
- 7.7 Search engine 'stuffing'.
Attempting to appear on search engines by
listing hundreds of keywords that have
nothing to do with your webpage. This is
not only useless, but abusive. Websites
found to contain this type of abuse will
be given a choice of removing the false
keywords or be shutdown.
